On November 15, 2022, Kentucky Governor Andy Beshear signed an executive order pardoning those stopped or arrested for marijuana related charges marijuana for medical purposes. On January 1, 2023, the executive order went into effect.

The executive order pardons anyone accused of possession of marijuana if:

- The amount possessed is an amount legal in the state purchased and less than eight ounces.
- There is written recommendation by a Kentucky licensed healthcare provider or a provider in another state where medical marijuana is legal and the user has been diagnosed with at least one of 21 medical conditions, including cancer, ALS, epilepsy, Parkinson’s disease, Crohn’s disease, multiple sclerosis, post traumatic stress disorder, intractable seizures or pain, or a terminal illness.
Currently, possession of recreational marijuana is legal in Illinois, Virginia and Missouri. Illinois is a boarding state where Medical Marijuana can be purchased by Kentuckians. Out-of-state visitors are allowed to purchase medical cannabis flower, cannabis concentrate, or THC within cannabis-infused products with a valid ID.
Because the executive order only covers those arrested for possession of marijuana from another state, those who wish to apply for a medical marijuana recommendation will have to travel to another state to get it for now. The Kentucky House has passed a bill legalizing medical marijuana, but it must pass the senate before becoming law and outlining a process to license medical marijuana facilities in Kentucky. The closest states that will accept the new Kentucky medical marijuana recommendations are Michigan and Missouri. Because marijuana is still illegal according to federal law, care must be taken driving back from these states.
