Obtaining your Kentucky Medical Marijuana Recommendation
On November 15, 2022, Kentucky Governor Andy Beshear signed an executive order pardoning those stopped or arrested for marijuana related charges marijuana for medical purposes. This was done in response to the state’s high number of deaths due to opioid overdoses from people who needed help controlling chronic pain and getting addicted to opioids such as fentanyl, methamphetamines, and heroin that cause respiratory depression. On January 1, 2023, the executive order went into effect.

The executive order pardons anyone accused of possession of marijuana if:
Currently, possession of recreational marijuana is legal in Illinois, Virginia and Missouri. Illinois is a boarding state where Medical Marijuana can be purchased by Kentuckians. Out-of-state visitors are allowed to purchase medical cannabis flower, cannabis concentrate, or THC within cannabis-infused products with a valid ID.
Because the executive order only covers those arrested for possession of marijuana from another state, those who wish to apply for a medical marijuana recommendation will have to travel to another state to get it for now. The Kentucky House has passed a bill legalizing medical marijuana, but it must pass the senate before becoming law and outlining a process to license medical marijuana facilities in Kentucky. The closest states that will accept the new Kentucky medical marijuana recommendations are Michigan and Missouri. Because marijuana is still illegal according to federal law, care must be taken driving back from these states. With recreational marijuana states neighboring Kentucky, gaining access to needed relief, with your medical marijuana recommendation, is easy and convenient. In states like Missouri, possession of non-medical marijuana is legal.
Who will be eligible for a Kentucky medical marijuana recommendation? According to the State of Kentucky, anyone who is a Kentucky resident with proof of residency (Kentucky driver’s license or Kentucky state ID), has been diagnosed with any of 21 specific conditions, and has a written certification from a Kentucky licensed physician will be eligible to purchase a medical marijuana recommendation.
Bypass the lines with “VIP Dispensary Access”: The last thing someone who is suffering from a physical or mental issue wants to do is wait in the long lines with recreational users that will occur.
Employee Protection: Employees who test positive for cannabinoids cannot be fired as long as they were not using, possessing, or under the influence during their work day or using a form of marijuana during the work day. Previously, employers were allowed to discriminate against employees for using marijuana, even if it was under the care of a doctor. Certain industries may still enforce a clean workplace.
Custody Protection: Medical marijuana users and their caretakers cannot be stopped and charged for possession of over the recreational limits or for growing marijuana in a secured greenhouse with the user’s name on each plant.
